Terms & Conditions

These terms and conditions govern your use of the AHEAD Start online training course. Please read them carefully before confirming your registration.

By registering for this course/package, you agree to accept without modification the Terms and Conditions are below. By viewing and participating in the course you are deemed to consent to and accept the Terms and Conditions.

We reserve the right to change these Terms and Conditions at any time. Any changes are effective immediately upon posting to our website. Participants will be notified of any changes to the terms which occur during term time. Your continued use of AHEAD Start constitutes your agreement to such Terms and Conditions.

1. Your Status

In order to book a training course you must be at least 18 years old and you must be legally capable of entering into binding contracts. 

2. Availability of Training Courses

Any booking for a training module placed through our booking site is subject to the minimum number of students required for us to run a full term. If this number is not met you will be fully refunded shortly after the proposed term start date. We reserve the right to decline to supply any individual or company, or to refuse any booking for a training course.

3. Payment

Payment can be made online with the following payment methods accepted: Visa, MasterCard, Maestro, American Express, and PayPal. The following offline payments are also accepted: Electronic Bank Transfer, Cheque. If paying ‘offline’, be sure to reference the invoice number in correspondence with us.

3.1 Credit Terms and Conditions

Individual Bookings

Full payment is due by the term start date. Only full payment secures a place on the course. AHEAD reserves the right to cancel a student’s registration if full payment has not been received by this time.

Company Bookings

If not paying online, an invoice will be sent out within 10 working days of the booking and payment should be made at the latest two weeks after the term start date. AHEAD reserves the right to cancel a student’s registration if full payment has not been received by this time. 

Course Cancellation

No refund will be made to students who fail to complete the course or who do not attend any seminars  included in the package. Cancellations made 30 days or more prior to the term start date will receive a full refund. Cancellations made between 29 and 7 days prior to the term start date will receive a 50% refund. If registration is cancelled less than 7 days before the term start date, no refund will be given and the full fees will be charged.

Course Transfers/Substitutions

Companies and individuals may substitute registered participants at any time prior to the start date of the term without additional payment. Companies and individuals can request a transfer of their booking(s) to another date and AHEAD will cater for this at no additional charge where possible however, AHEAD reserves the right to deny such requests. Course transfer requires that notification by phone or e-mail is received by AHEAD at least 3 working days prior to the term commencement date. Please note that in the case of packages where a seminar is included, the desired seminar accompanying the online AHEAD Start enrolment is selected by the participant/company at the time of booking and is non-transferable except in exceptional circumstances. AHEAD reserves the right to deny any requests to transfer to another associated seminar.

Disclaimer

AHEAD reserves the right to cancel or re-schedule any course (or associated seminar) at any time. In the unlikely event of cancellation, fees will be refunded in full. AHEAD also reserves the right to re-schedule the start dates of all terms (and if applicable, seminar dates) and, if necessary, to vary/update the content. Except where expressly stated, all fees are non-refundable. While every effort has been made to ensure the accuracy of the information on AHEAD Start, it may be subject to later alteration or amendment in the light of policy changes, course updates or other constraints.

4. Cancellation and Refund Policy

We reserve the right to cancel any course. We shall not be required to provide any reason for such a cancellation. In that event you will be entitled to a full refund.

5. Course Extensions

AHEAD will only consider requests to extend a student’s enrolment period past the term end date if there are legitimate and extenuating circumstances which have prevented the student from completing on time - in such cases a short extension or postponment of enrolment to a later term may be granted. The course fee does not include an extension period and as such, AHEAD reserves the right to deny any requests for extension if the reasons for the non-completion on time are not deemed adequate.

6. Terms

You will have access to the course material for a period of 7 weeks from the term start date specified on your booking confirmation.
You will be issued with a user name and password to facilitate your log in to the course material. Your subscription, and the user name and password, are personal to you and cannot be transferred to any other person without the prior written consent of AHEAD. Should you give your user name and password to any other person and in the event that the course material is accessed by a third party to whom you have given your username and password, AHEAD may terminate your subscription without obligation to refund any fees.

7. Liability and Disclaimer

To the extent permitted by law, we provide AHEAD Start without any warranties or guarantees. In particular, we do not warrant that AHEAD Start or any of its contents are virus free. You must take your own precautions in this respect, as we accept no responsibility for any infection by virus or other contamination or by anything, which has destructive properties. Although we do our best to provide constant, uninterrupted access to AHEAD Start, we do not guarantee this - there may be occasional interruptions to service where for example we are updating the Moodle platform. We accept no responsibility or liability for any interruption or delay. AHEAD Start provides content from other sources and while we try to ensure that material included on AHEAD Start is correct and up to date, we cannot accept responsibility if this is not the case. This disclaimer does not affect your organisation’s statutory rights.

To the full extent allowed by law, you agree that AHEAD will not be liable to you for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or relating to AHEAD Start. If we are found to be liable to you our liability shall not exceed the course fees.

8. Use of Material on AHEAD Start

For the purposes of this agreement, "material" includes, without limitation, text, video, graphics and sound material, published on AHEAD Start. You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the material appearing on AHEAD Start. You must not reproduce any part of AHEAD Start or the material or transmit it to or store it in any other website or disseminate any part of the material in any other form, unless we have indicated that you may do so. Where templates are given in the material, you may use these as the basis for company forms etc. but use of the actual forms provided without modification is prohibited.

9. Governing Law

The Terms and Conditions shall for all purposes be governed by and interpreted in accordance with the laws of Ireland. You and AHEAD agree to submit to the exclusive jurisdiction of the Courts of Ireland. The place and performance of this agreement shall be Ireland.

10. Data Protection

All information received by us from your use of AHEAD Start will be kept in strict confidence. We do however reserve the right to publish the names of the educational institutions which have had employees registered on AHEAD Start. We respect the value of personal information provided by you and will only otherwise transfer this information to the software host for AHEAD Start in order to facilitate your booking. Be aware that usernames of all registered participants may default to a format of first initial followed by second name (or similar) and that these usernames will be viewable by all students undertaking the same term of AHEAD Start.
